EU AI Act: What It Means for Job Seekers and Migrants
How the EU AI Act regulates AI used in hiring, workplace management and migration, with key compliance dates through 2027.
AI Act: What It Means for Job Seekers and Migrants
The EU AI Act (Regulation (EU) 2024/1689) sets rules for artificial intelligence across the European Union.
What it does not change
It is not a visa or work-permit scheme: it does not change who is eligible to enter, work or live in an EU country, nor any salary thresholds or fees.
What it regulates
It regulates AI used in hiring and workplace management, and certain AI tools used by public authorities in migration, asylum and visa procedures.
Key points
- Hiring and work: AI tools that screen or select candidates, decide on promotion or dismissal, or monitor and evaluate workers are generally classified as “high-risk”.
- Migration: Certain AI systems used by authorities to assess visa, residence-permit or asylum applications are also high-risk. Systems that only verify travel documents are excepted.
- Obligations: Employers and authorities using high-risk systems must provide human oversight, record-keeping and transparency.
- Ban: Emotion recognition in the workplace is banned, except for medical or safety reasons (applies since 2 February 2025).
New dates
Under the 2026 “Digital Omnibus” amendment (Regulation (EU) 2026/1744), the high-risk rules for hiring and migration systems now apply from 2 December 2027 (previously 2 August 2026). Rules for AI embedded in regulated products apply from 2 August 2028.
What this means for you
An employer using AI to screen CVs is not automatically breaking the law, and a recruitment algorithm can never grant or extend your right to work. Keep your applications and correspondence, give accurate information, and if you have a concrete concern about an automated decision, ask the employer how it was made. Keep following the current visa and work-permit rules of the country you are applying to.
